【本報訊】正在美國還柙的前民政事務局局長何志平，早前向法庭申請撤銷8條控罪中的6條控罪，以及要求禁止部份手機資料及數千封電郵等證物呈堂。法庭香港時間昨日凌晨開庭處理，法官最終否決何所有申請，所有控罪及證物維持不變，貪污案將於今年11月正式開審。
何志平被控5條違反《海外反腐敗法》罪，辯方律師認為其中兩條控罪指何作為美國國內業務（domestic concern）的代理人而犯法，但另外3條控罪卻引用另一條文，指他作為國內業務以外的人而犯法，辯方認為兩組控罪就被告的身份自相矛盾。不過，法官認為「國內業務代理人」和「國內業務以外的人」兩個身份並無直接衝突，何志平可同時受以上條文約束，所以拒絕撤罪。
