The Court of Appeal in Putrajaya has struck out an appeal by four student activists over charges that they were assembled at a prohibited area during the Blackout 505 Rally at Padang Merbok in 2013.
The student activists who were charged under Section 4(2) (b) of the Peaceful Assembly Act 2012 for participating in an assembly at a prohibited place are represented by lawyer Eric Paulsen who believes that they have been cornered as lower courts have no jurisdiction on constitutional questions.
The students are Adam Adli Abdul Halim, 28, Muhammad Safwan Anang, 28 Ekhsan Bukharee, 26. and Mohamed Bukhairy Mohamed Sofian, 27.
