We already know that Taylor claims her phone call with Kanye was recorded in secret without asking for her permission, which violates California’s “two party consent law.” However, Kanye is claiming that Taylor could clearly hear producer, Rick Rubin talking, and even other members of the crew in the background. Meaning that the convo was overheard by others and therefore, recording it was not a crime.
BUT NOW, sources are saying that Taylor had NO IDEA that Kanye even had her on speaker phone in the first place. Even though she could hear other voices in the room, she assumed they couldn’t hear her side of the conversation. So Taylor claims that Kanye still needed to ask permission to record her. If that’s the case, Taylor could still be deciding if she wants to file a police report.
PLUS, it’s reported that Taylor is ready and willing for the ENTIRE conversation to be released, not just the few clips that Kim chose to post. She wants everyone to see that Kanye never said that he was going to call her a “b*tch” in the song and made the whole thing sound very lighthearted. Taylor’s rep even commented that Kanye never officially asked Taylor for approval and she believes he was being deceptive.
During the call Kanye also promised to send Taylor an advanced copy of the song before it was released, which apparently he never got around to doing.
So what happens if Taylor DOES decide to file a police report? Kanye AND Kim both could be looking at criminal prosecution for violating California’s eavesdropping statute. Kanye for recording the call without Taylor’s consent, and Kim for recording the recording of that illegal phone call as well. Sheesh.
Now, it this could go a few different ways. If charged as a misdemeanor, then Kimye could face up to a year in county jail and/or a 2,500 dollar fine. A first offense felony would cost the same, but instead face up to 3-years in a STATE PRISON. OR if it was a second offense, then the fine would go up to 10-thousand dollars. Are you still following?
Taylor could also sue, not just for violating the statute, but also for defamation, plus intentional infliction of emotional distress. If she could prove it, then she could sue Kimye for THREE TIMES the amount of damage.
Yikes. Okay, this is a lot to take in, but I want to know what you guys think about the whole situation. Do you think Taylor should sue?
