Players Gon’ play and Haters Gonna Hate.
Last fall songwriters Nathan Butler and Sean Hall sued Taylor Swift claiming that Taylor Swift’s song “Shake It Off” borrowed from a song they wrote for 3LW called Playas Gon’ Play. We all know In Taylors song she says the Players gonna play play play play and haters gonna hate hate hate hate. This is the 3LW line for reference:
Well Judge Michael W Fitzgerald dismissed the lawsuit yesterday ruling that combining the phrases “Playas gonna play” and “haters gonna hate” does NOT entail sufficient originality to warrant copyright protection. He said QUOTE: By 2001, American popular culture was heavily steeped in the concepts of players, haters, and player haters. The concept of actors acting in accordance with their essential nature is not at all creative; it is banal”.
He went on to say "In sum, the lyrics at issue... are too brief, unoriginal, and uncreative to warrant protection under the Copyright Act,".
BUT he did offer Nathan & Sean one last chance to amend their argument before the case is closed. Nathan and Sean’s lawyer Gerard Fox said that due doesn’t plan on amending their argument but they are going to appeal it. He thinks the judge should of found a music expert to rule on the originality of lyrics instead of interpreting the lyrics himself. He said QUOTE "He cannot make himself an expert in the music industry I'm sorry It’s actually embarrassing."
